These Terms of Service ("Terms") apply when you visit this website or buy from it. The website is operated by Raise Vibrations Ventures LLC ("LeakFree", "we", "us"), a Wyoming limited liability company, 30 N Gould St Ste R, Sheridan, WY 82801. By using the website or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy and our Refund Policy.
Please read section 12 carefully. It contains an arbitration agreement and a class action waiver that affect how disputes are resolved. You can opt out within 30 days.
1. Who can buy
You must be at least 18 years old, or the age of majority where you live, to place an order. We sell to customers in the United States only.
2. Our products
LeakFree products are everyday underwear with a built-in absorbent panel. They are apparel.
We describe our products as accurately as we can, including fiber content and country of origin. Colors on screen can look slightly different from the real fabric. Follow the care instructions on the label.
3. Prices and orders
Prices are shown in US dollars. Sales tax and shipping are shown at checkout before you pay. Your order is an offer to buy. A contract is formed when we send you the shipping confirmation.
We may limit quantities, refuse or cancel an order, for example if a product is unavailable, if a price was shown in error or if we suspect fraud. If we cancel an order you already paid for, we refund you in full.
4. Payment
Payments are processed by Shopify and its payment partners. We do not store your full card number. You confirm that you are allowed to use the payment method you provide.
5. Shipping, cancellations and returns
Shipping times and costs are described in our Shipping Policy. Cancellations, returns, refunds and the 30-Day Wear-It Guarantee are described in our Refund Policy. Both are part of these Terms.
6. Warranty
If a product has a manufacturing defect, our Refund Policy explains how we replace it or refund you. Except for that and except where the law does not allow it, products are provided without other warranties, express or implied. Some states do not allow the exclusion of implied warranties, so this may not apply to you. In those states any implied warranty is limited to 30 days from delivery, unless the law requires a longer period.
7. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages arising from the use of our website or products. Our total liability for any claim related to a product is limited to the amount you paid for that product. Some states do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
8. Reviews and feedback
You are free to share honest reviews of our products anywhere, positive or negative. We do not restrict or punish honest reviews. If you submit a review on our website, you allow us to display it on the website and in our marketing with your first name and last initial. We do not edit the meaning of reviews and we do not publish fake reviews.
9. Website content
All text, photos, logos and designs on this website belong to us or our licensors. You may not copy or use them commercially without our written permission.
10. Acceptable use
Do not use the website for anything unlawful, do not try to break or overload it, and do not collect data from it with automated tools.
11. Emails and messages
If you sign up for our emails, you can unsubscribe at any time with the link in every email. We only send text messages if you have agreed to receive them separately.
12. Dispute resolution, arbitration and class action waiver
Talk to us first. Most problems can be solved quickly. Before starting any claim, email us at evoke-repair-kept@duck.com with your name, order number and a description of the problem. We both agree to try to resolve it in good faith for 30 days.
Arbitration. If we cannot resolve it, you and we agree that any dispute about the website, your order or our products will be decided by binding individual arbitration, not in court. The arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules. For claims under $10,000 we pay the filing, administration and arbitrator fees beyond what you would pay to file in court. The arbitration can take place by video, by phone, on written submissions or in the county where you live.
Small claims. Either of us may bring an individual claim in small claims court instead, if it qualifies.
No class actions. Claims may only be brought individually, not as a plaintiff or class member in a class, collective or representative action. If this waiver is found unenforceable for a claim, that claim goes to court and not to arbitration.
Opt out. You can opt out of this section within 30 days of your first order. Email evoke-repair-kept@duck.com with the subject "Arbitration opt-out", your name, address and order number. Opting out does not affect anything else in these Terms.
13. Governing law
These Terms are governed by the laws of the State of Wyoming and the Federal Arbitration Act, without regard to conflict of law rules. Where a court case is allowed, it will be heard in the state or federal courts located in Wyoming, unless the law of your state gives you the right to sue where you live.
14. Changes
We may update these Terms. The version shown on this page with its effective date applies to orders placed from that date on.
